Terms & Conditions

These Terms & Conditions (the “Terms”) govern the use of the takeanap.bg website (the “Website”). They are written to be read in five minutes. If a question remains afterwards, write to us at hi@takeanap.bg.

1. What these terms cover

The Terms apply only to the Website: the homepage, the solution and integration pages, the articles, the calculator, the pricing page and the contact form.

They do not govern the use of the Take a NAP service itself. The service has separate Terms of Service. You accept them when you create an account, and you can open them at any time from your profile in the web app at app.takeanap.bg. They also apply to our apps in the Shopify App Store and the Wix App Market, and to the public API. Every version of those terms has an identifier, and your consent to the specific version is recorded.

If this document and the Terms of Service conflict on a matter that concerns the service, the Terms of Service prevail.

2. Who is behind the website

The Website is operated by Softaware Ltd. (Софтауеър ООД), a company registered in the Republic of Bulgaria and entered in the Commercial Register under UIC 206609469. Take a NAP is a product and brand of Softaware Ltd. Throughout the Terms, “we”, “us” and “our” refer to Softaware Ltd.

3. Acceptance of the terms

By browsing or using the Website you accept these Terms. If you do not accept them, do not use the Website. The Terms apply to every visitor, whether or not they have an account in the service.

4. Content is information, not advice

The articles, the solution pages, the FAQ and the calculator explain how the Alternative Regime under Ordinance H-18 works and how Take a NAP automates it. This content is general information. It is not legal, tax or accounting advice and does not replace your accountant’s judgement about your specific shop.

We keep the content current, but the regulations change. Links to legal texts on lex.bg lead to an external source. The text of the act in force is always authoritative, not our summary.

The calculator produces indicative values based on the data you enter and the assumptions described next to it. The result is not an offer and not a guarantee of a specific cost or saving.

5. Prices

Prices on the Website are indicative and exclude VAT unless stated otherwise. The binding price is the one you see in the app or in the relevant marketplace at the moment you subscribe. On platforms with their own marketplace, such as Shopify and Wix, prices and terms follow the marketplace rules and may differ from those shown here.

6. Customer reviews and logos

The reviews on the Website come from real customers. They were published by them in app marketplaces, such as the Shopify App Store, or sent to us. We edit them only for translation, length and spelling, without changing their meaning.

Customer logos belong to their respective owners. We display them solely to indicate that these companies use Take a NAP. This does not mean that they endorse the service or are otherwise affiliated with us.

7. What is not allowed

Use the Website only for lawful purposes. You may not:

• attempt unauthorised access to the Website, its servers or the systems connected to it;
• extract or copy content by automated means (scraping) without our written consent;
• interfere with the normal operation of the Website, including through excessive traffic or malicious code;
• use the contact form for unsolicited commercial messages or bulk sending;
• impersonate another person or Take a NAP.

We reserve the right to restrict access to the Website if these rules are broken.

8. Intellectual property

The Take a NAP name, the logo, the texts, images, design and code of the Website belong to Softaware Ltd. or our licensors and are protected by copyright and applicable law. The Take a NAP name and logo are distinctive signs of Softaware Ltd. and may not be used without our written consent.

You may quote excerpts from our articles with attribution and a link to the original. You may not reproduce entire pages or articles, sell them or present them as your own.

Shopify, WooCommerce, Wix, Stripe and the other platforms named on the Website are trademarks of their respective owners. Take a NAP is an app published in their marketplaces or integrated with their APIs and is not otherwise affiliated with them.

9. Contact form and communication

When you write to us through the form or at hi@takeanap.bg, we process your data according to the Privacy Policy. We use it to reply to you and for nothing else.

We aim to reply within one working day. That is our practice, not a contractual obligation. Do not send passwords, API keys or personal data of your customers through the form. For such matters open a ticket from the app, where the communication is protected.

The form is not a channel for legal notices. Send those to legal@softaware.io.

10. Links to other sites

The Website links to external sites: lex.bg, the NRA portal, the e-commerce platforms and their marketplaces. We are not responsible for their content, policies or availability.

The official Take a NAP addresses are takeanap.bg, app.takeanap.bg, api.takeanap.bg and our listings in the Shopify App Store and the Wix App Market. If you see Take a NAP at another address that is not listed on the Website, it may be an imitation. Write to us so we can check.

11. Cookies and analytics

The Website uses cookies and similar technologies for traffic analytics and for the operation of some features. Non-essential cookies are loaded only after your consent in the banner. The details are in the Privacy Policy.

12. No warranties for the website

The Website is provided “as is”. We take care that the content is accurate and the Website is available, but we do not guarantee that it will operate without interruption or errors, or that every piece of information on it is complete and current at every moment.

13. Limitation of liability

To the extent permitted by law, we are not liable for indirect or consequential damages, lost profits or loss of data arising from the use of the Website or from the inability to use it, including from decisions taken on the basis of information on the Website.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, including liability for intent or gross negligence.

14. Changes to the terms

We may change these Terms. The effective date is at the top of the document, and the current version is always this page. We will mark material changes clearly here. If you continue to use the Website after a change, you accept the new version.

Changes to the Terms of Service are communicated separately, in the manner described in them and in the app.

15. Governing law and disputes

The Terms are governed by the laws of the Republic of Bulgaria. In case of a dispute, write to us first at hi@takeanap.bg and we will try to resolve it directly. If we cannot, the competent court in Sofia has jurisdiction.

If you use the Website as a consumer within the meaning of the Consumer Protection Act, these Terms do not limit the rights the law gives you.
